Regular Council Meeting December 15, 2003 – 5:30 P.M. The West Burlington City Council met in Regular Session at 118 W. Wheeler Street with Mayor Trousil presiding. Council Members Lees, Crowner, Pilger and Hockett were present. Johnson was absent. Fire Chief Astfalk, Public Works Director Fry and Police Chief Oblein were also present. Mayor Trousil removed item one under Old Business, "To consider the third reading of an ordinance concerning open burning", until all council members were present. Lees moved, second by Pilger, to approve the Agenda as amended. Voice vote. All ayes. Motion carried.

    Lees, second by Crowner, to approve the Consent Agenda as presented. Voice vote. All Ayes. Motion carried.

    COMMITTEE REPORTS

    STREETS – Discuss Resident Request for "No Parking" on Brushtown Lane – John Crowner, resident of Brushtown Lane, asked the Council to consider adopting an Ordinance forbidding parking on Brushtown Lane. He said there is a resident on the road that parks in the road and makes two way travel difficult. He said he has asked them not to park there but only receives profanity in response. He said the road is only 20 feet wide and there are plenty of other places to park.

    Sandra Scott said she does park on the road and doesn’t feel it causes a problem. She said the road is not finished and will not be until next spring. She said they are not blocking the road; there is plenty of room the way it is. She also said they received permission from City Officials to park where they are parking.

    The Council agreed they, along with staff, will drive out there and look at the situation.

    Council Member Lees said the center turning lane on Agency Road is confusing to some drivers; she said people are not turning into the turn lane as they should. City Administrator Mandsager said it is different and drivers will need to adjust to it.

    Council Member Pilger said he observed near accidents at the mall this weekend. He said the problem is occurring at the west exit from the mall onto Gear Avenue where left turns are not allowed. Drivers are turning left anyway. He said there is a sign there stating no left turn but it is being ignored. He is concerned someone is going to get hurt. He said the signs should be enforced.

    Administrator Mandsager said the no left turn from the Mall Road onto Gear Avenue was a condition of the State when the new Traffic Signals were installed last year. The Council discussed options to cure the situation and Administrator Mandsager was instructed to contact the Iowa Department of Transportation to discuss the situation.

    SANITATION – There was nothing to report.

    UTILITIES – There was nothing to report.

    PUBLIC SAFETY – Fire Chief Astfalk said the department is installing equipment in the new fire truck.

    Police Chief Oblein said the Police Department received a STEP Grant which is used for impaired driver’s enforcement.

    FINANCE – Public Works Director Fry said the 10 picnic tables on the Consent Agenda are to be located in various parks. He wants to replace all tables in the parks with plastic coated tables within the next 2 – 3 years.

    NEW BUSINESS:

    Consider Approval of Fire Department Officers – Lees moved, second by Crowner, to approve the Fire Department appointments as recommended by the Department. Terry Kesterke, Chief; Tim Kesterke, First Assistant Chief and Paul Barnett, Second Assistant Chief. Voice vote. All ayes. Motion carried.

    Consider Change Order for Brushtown Road Project – Hockett moved, second by Crowner, to approve a Change Order for the Brushtown Road Project in the amount of $1,822.73. The Change Order is necessary because two residences had unacceptable sewer plumbing and were re-plumed to provide an adequate connection to the new sewer services. Also an existing water main size was unknown near Brushtown Road, a change in materials was necessary to make the new water main tap. Heat tapes and insulation were installed at two residences to ensure that water pipes and connections would not freeze during the winter months. Also, an additional concrete manhole barrel section was required as a result of a field design change in the sanitary sewer system. Voice vote. All ayes. Motion carried.

    Consider Payment to Shipley Contracting for Brushtown Road Project – Hockett moved, second by Crowner, to approve payment in the amount of $7,243.67 to Shipley Contracting for the Brushtown Road Project. Voice vote. All ayes. Motion carried.

    Consider Agreement with French-Reneker Associates to Prepare the 5-Year Street Program Update – Hockett moved, second by Crowner, to approve contracting with French-Reneker Associates to update the 5-Year Street Plan. Administrator Mandsager said as we near completion of our current program, he feels it is prudent to establish a new 5-Year program to properly plan for future work. The cost for the update is a lump sum fee of $850. Voice vote. All ayes. Motion carried.

    Consider Contribution to West Burlington Schools Roof Project – Lees moved, second by Crowner, to contribute $50,000 to West Burlington Schools to be used for the roof project at the high school. Voice vote. All ayes except Hockett who voted nay.

    Consider Payment to First Construction Group for City Hall Project – Lees moved, second by Crowner, to approve payment to First Construction Group in the amount of $287,419.65 for the City Hall Project. Voice vote. All ayes except Hockett who voted nay. Motion carried.

    Consider Payment to Snyder & Associates for Various Engineering Projects – Pilger moved, second by Crowner, to approve payment in the amount of $3,661.89 for various engineering projects. Voice vote. All ayes. Motion carried.

    Consider Payment to McClure Engineering for Agency Road Project – Hockett moved, second by Lees, to approve payment in the amount of $750.90 to McClure Engineering for work completed on the Agency Road Project. Voice vote. All ayes. Motion carried.

    Consider Payment to Metzger Johnson Architects for City Hall Project – Crowner moved, second by Pilger, to approve payment to Metzger Johnson in the amount of $4,854.83 for work completed on the New City Hall Project. Voice vote. All ayes except Hockett who voted nay. Motion carried.

    Consider Resolution Setting Public Hearing for Use of Right-of-Way for McLeodUSA – Crowner moved, second by Lees, to approve a setting a Public Hearing for January 12 at 5:30 to consider applications from McLeodUSA for right-of-way permits. Roll call. Ayes: Hockett, Lees, Crowner and Pilger. Nays: None. Motion carried.

    OLD BUSINESS:

    Consider Ordinance Concerning Open Burning – Third Consideration – This item was not discussed.

    OATH OF OFFICE:

    Mayor Trousil administered the Oath of Office to Fire Chief Terry Kesterke whose three year term begins January 5 and to Council Members Therese Lees, Rick Raleigh and Rod Crowner whose four year terms begin January 2. City Clerk Simonson administered the Oath of Office to Mayor Trousil whose two year term begins January 2.

    MAYOR’S INQUIRIES:

    Mayor Trousil presented a plaque to Dan Hockett in appreciation of his service to the City as Council Member.
