Regular Council Meeting November 13, 2001 5:30 P.M.
The West Burlington City Council met in Regular Session at 118 W. Wheeler Street with Mayor Trousil presiding. Council Members Hockett, Crowner, Johnson, Lees and Pilger were present. City Administrator Mandsager, Police Chief Walters, Public Works Director Fry, and Building Inspector Hoy were also present. Lees moved, second by Crowner, to approve the Agenda as presented. Voice vote. All ayes. Motion carried.Lees moved, second by Pilger, to approve the Consent Agenda as presented. Voice vote. All ayes. Motion carried.

PUBLIC HEARING Application for Community Development Block Grant for Brushtown Road -
Susan Coffey Southeast Iowa Regional Planning Commission Mayor Trousil opened the Public Hearing concerning the Application for Community Development Block Grant for the construction of the sewer in the Brushtown Road area. Susan Coffey with Southeast Iowa Regional Planning Commission explained the process to the Council.
They discussed that the need for a sanitary sewer system in the Brushtown area of the City of West Burlington was identified by residents who use their own private well and on-lot septic systems, and that Burlington Northern Santa Fe will be installing city water into the area.
Ms. Coffey discussed the Community Development Block Grant Program which is through the Iowa Department of Economic Development. She explained the Community Development and Housing Needs Assessment is required by federal law for each local government application. She said the City must identify community development and housing need, including the needs of low and moderate income (LMI) persons and activities that will be undertaken to meet their needs. She said the CDBG grant will fund the Brushtown area Sanitary Sewer Project. The application for the CDBG Brushtown Sewer Project is due December 6, 2001. The City of West Burlington is requesting $600,000 from the Iowa Department of Economic Development for the Brushtown Area Sanitary Sewer Project. Fifty Six (56%) percent of the grant funds will benefit the Low and Moderate Income persons in the Brushtown area. The Sanitary Sewer Project will be constructed in the Brushtown area of the City of West Burlington. During construction of the project there should be no residents that will have to be displaced. The City will adopt a Residential Anti-Displacement and Relocation Assistance agreement.
There were no further comments. The Public Hearing was closed.
COMMITTEE REPORTS:
FINANCE Administrator Mandsager said he has discussed the demolition of the old City Hall with the engineers and has developed specifications for the project. The Council agreed we should advertise in the newspapers and also mail to Demolition Contractors. It was the consensus of the Council Members this should be done as soon as possible.
STREETS Public Works Director Fry said Shipley is starting this week on the storm sewer project this week. He said the out-fall portion of the project needs to be done this winter.
The Council asked Fry if the sign (warning of hidden driveways) had been placed on Gear Avenue. Fry said it was ordered and should be in this week. The Council discussed where the City Limits on Gear actually is. Fry said he will find out and report back to them at the next meeting.
SANITATION There was nothing to report.
UTILITIES Set Work Session for Curb Box Project The Council agreed they would discuss the Curb Box Project during the Budget process.
PUBLIC SAFETY There was nothing to report.
NEW BUSINESS:
Consider Approval of Preliminary and Final Plat for the Shottenkirk Estates Subdivision The Council discussed the Final Plat for the Shottenkirk Estates Subdivision. Administrator Mandsager said the City must approve the street names. He said the developer should reconsider lot 19 as well as 13 and 14. Because of the high-pressure gas line running through the subdivision, those lots should be either combined with adjoining lots or made green space. The Council suggested the Developer consider this. The Council also agreed sidewalks should be placed on both sides of the street in the residential area.
The Council members reviewed the restrictive covenants and made several suggestions for changes. The Council will consider the preliminary and final plat at the next Council Meeting.
Consider Ordinance Amending the Sign Code Concerning Signs in Residential Districts Hockett moved, second by Pilger, to approve the first consideration of an Ordinance amending the Sign Code concerning signs in a Residential District. The amendment would include allowing schools (as well as churches) to place a ground sign in a Residential District. Roll call. Ayes: Lees, Hockett, Crowner, Pilger and Johnson. Nays: None. Motion carried.
Consider Ordinance Amending the Traffic Code Concerning Parking and Stop Signs Hockett moved, second by Crowner, to approve amending the traffic code concerning parking and stop signs. Roll call. Ayes: Lees, Hockett, Pilger, Crowner and Johnson. Nays: None. Motion carried.
Consider Engineering Services Agreement with Snyder & Associates for Brushtown Road Project Hockett moved, second by Johnson, to approve an engineering services agreement with Snyder and Associates for Final Project Development Services and Easement Acquisition for the Brushtown Road Project. Voice vote. All ayes. Motion carried.
Administrator Mandsager said Burlington Northern has agreed to fund $75,670 for the final project development phase of the project. He said Burlington Northern will be providing the City with a letter agreeing to pay for the services.
Consider Engineering Services Agreement with French-Reneker for Shottenkirk Development Project Administrator Mandsager said he recently met with Tony Baxter to discuss the construction project and inspection. He said he asked French-Reneker to accompany him to the site and the meeting. Shottenkirk is utilizing a construction manager for this project (Tony Baxter). Normally engineers utilize a member of their own engineering team to conduct inspection and receive test results. Their engineer, Bruner, Cooper, Zuck, is relying on Baxter to receive inspection data and to cure any defects. Mandsager said he would feel more comfortable having an agent that is working directly for the City to review the inspection and work being completed. He recommended hiring French-Reneker to provide engineering services on behalf of the city with a budget of $4,700. This is a TIF eligible expense.
Lees moved, second by Pilger, to approve a contract with French-Reneker for the Shottenkirk Development Project with a budget of $4,700. Voice vote. All ayes except Hockett who voted nay. Motion carried.
Consider Payment to Dorsey & Whitney for Legal Fees for Shottenkirk Development Agreements Administrator Mandsager presented a bill from Dorsey and Whitey for costs in connection with the drafting and negotiations related to the Shottenkirk Development Agreements in the amount of $10,034.52. These expenses will be reimbursed by Shottenkirk according to the development agreement. Voice vote. All ayes. Motion carried.
Consider Janitorial Contract for Cleaning City Hall City Clerk explained with the City currently contracts with Barb and Lyle Ireland to clean City Hall. They are paid $175.00 per month or $43.75 per week. When we moved City Hall to the new location the Irelands said they would need $350 per month ($87.50 per week. Because of the increase bids were solicited from other cleaning companies. Four bids were received.
Rhonda Junker bid $45.00 per week or $195 per month which was the low bid. Lees moved, second by Crowner, to approve contracting with Rhonda Junker to clean City Hall for $45 per week for a period of twelve months. Voice vote. All ayes except Hockett who voted nay.
OLD BUSINESS:
Discuss Design of New City Hall Metzger-Johnson Dave Metzger and Martin Salino-Hugg from Metzger Johnson reviewed the compiled list of suggested items for the New City Hall. The next phase will be to develop a schematic drawing. The Council discussed whether the building will be one or two story and whether it will have a basement. The group will meet again for further discussion.
PROCLAMATION: Burlington West Burlington Area United Way Time Mayor Trousil proclaimed the month of September 12 through November 15 as Burlington/West Burlington Area United Way Time.

Pending Litigation Chapter 21.5 c. State Code of Iowa Johnson moved, second by Pilger, to go into closed session in accordance with Chapter 21.5 c. State Code of Iowa for the purpose of discussing pending litigation. Roll call. Ayes: Lees, Johnson, Pilger, Hockett and Crowner. Nays: None. Motion carried. The closed session ended at 9:20 p.m.
