Regular Council Meeting October 08, 2001 – 5:30 P.M.
The West Burlington City Council met in Regular Session at 122 Broadway Street with Mayor Trousil presiding. Council Members Hockett, Crowner, Johnson, Lees and Pilger were present. City Administrator Mandsager, Police Chief Walters and Public Works Director Fry, and Fire Chief Astfalk were also present. Lees moved, second by Hockett, to approve the Agenda as presented. Voice vote. All ayes. Motion carried.Hockett moved, second by Lees, to approve the Consent Agenda as presented. Johnson said he would like the Beer and Wine License for The Barn at 701 Agency removed and placed under Old Business for discussion. Voice vote. All ayes. Motion carried.

CITIZEN’S INQUIRIES: - None
COMMITTEE REPORTS:
FINANCE – Administrator Mandsager said the Derby’s are out of their Furniture Store. He said we will be able to start readying the place for location of the City Offices. It was the consensus of the Council Members to have a final lien search done before closing the sale.
STREETS – Administrator Mandsager said Leffler Street is completed. He said there is a pre-construction conference scheduled for 10:00 tomorrow.
SANITATION – Public Works Director Fry said the first day of Fall Clean-Up went well. He also said two of his part-time employees (Bob Summers and Bob Bence) will continue to work until probably the end of October. He said the department will not go over budget because he did not hire as many people as he had budgeted.
UTILITIES – Administrator Mandsager said he will be meeting with Chad Lambi, Shive Hattery, concerning the wastewater treatment facility on Wednesday. He said they will determine if the project is ready for acceptance. If it is the Council will consider the Final Pay Request at the next meeting.
PUBLIC SAFETY – Council Member Lees said the Fire Department is holding a Pancake Breakfast on Saturday, October 13. She said they had an Open House for Ken Beenblossom on October 6.
NEW BUSINESS:
Consider Approval of Snyder and Associates for the Engineer on the Brushtown Road Project – Administrator Mandsager said SEIRPC sent out a Request for Proposal requesting proposals for engineering work related to the potential Brushtown Road Improvements. This was a necessary step to formally meet certain requirements for CDBG funding. He said applicants were informed that we were presently working with Snyder and Associates and that he would be recommending their continued use on the project. Mandsager said we received two proposals one from Snyder and Associates and one from Shoemaker and Haaland from Keokuk.
Hockett moved, second by Pilger, to approve Snyder and Associates as our engineer on the Brushtown project for purposes of moving ahead with the grant application. Should the City move forward with the project, a formal agreement with Snyder will need to be adopted. Voice vote. All ayes. Motion carried.
Consider Payment to Shive-Hattery Engineers for Mt. Pleasant Street and Gear Avenue Traffic Signals – Hockett moved, second by Lees, to approve payment to Shive-Hattery Engineers for Mt. Pleasant Street and Gear Avenue Traffic Signals in the amount of $4,182.65.
Consider Payment to French-Reneker for Various Street Projects – Lees moved, second by Hockett, to approve payment to French-Reneker Engineers for various street projects. The first is in the amount of $3,208.56 and is for Wheeler and Glasgow Streets. The second is in the amount of $1,656.00 for the 5 year Street Improvement Plan. The third invoice is in the amount of $5,011.17 for the Pennington and Leffler Street Project. The total for all three invoices is $9,875.73. Voice vote. All ayes. Motion carried.
Consider Amending the Municipal Code Concerning Water Shut-Offs – Administrator Mandsager presented a draft ordinance concerning curb boxes and the City’s responsibility for their installation and maintenance. He said in drafting the ordinance and discussing its affects, it appears to be several ways in which the ordinance could be interpreted. Should the City install the piping and curb boxes in all cases even in alleys and on private property? Or should we develop a program more consistent with the sidewalk program where the homeowner or business would seek reimbursement for the curb box and a portion of piping and labor after the homeowner has installed or repaired their line and has met the code requirements? Mandsager said he does not like the responsibility of having to work on private property.
The Council discussed different options including adopting the ordinance with a separate Resolution for fees. After considerable discussion the Council decided to hold a work session to discuss the subject in more detail. In the meantime Public Works Director Fry will take photos of problem locations where curb boxes are located on private property etc. under driveways, decks, and inside garages. He was also directed to search for curb boxes that can go in alleys.
OLD BUSINESS:
Consider Liquor License Application for The Barn – 701 Agency Road – Johnson said he asked for this item to be pulled from the Consent Agenda for discussion. At the last Council Meeting Gary Hall applied for a Liquor License for The Barn. It was determined by the Police Chief that he did not provide correct information concerning liquor violations on his application and the application was denied. Janet Hall is applying for this license and she is Gary Hall’s mother. It appeared her application was in accordance with State Law.
Pilger moved, second by Hockett, to approve the Liquor License for The Barn at 701 Agency Road. Voice vote. All ayes. Motion carried.
PROCLAMATIONS:
Manufacturer’s Month – October 2001 – Mayor Trousil proclaimed the month of October as Manufacturer’s Month and saluted all area manufacturers for the major impact they have made on the City of west Burlington.
Fire Prevention Week – October 7 – 13, 2001 –Mayor Trousil proclaimed the week of October 7 – 13 as Fire Prevention Week and asked residents to participate in fire prevention activities at home, work and school, and to heed the message: "Let’s Hear It for Fire Safety: Test Your Detectors!".

Evaluation of City Administrator – Lees moved, second by Johnson, to go into Closed Session in accordance with Chapter 21 of the Iowa Code concerning the Iowa Open Meetings law.Roll call. Ayes: Lees, Johnson, Pilger, Hockett and Crowner.
