Regular Council Meeting September 24, 2001 – 5:30 P.M. The West Burlington City Council met in Regular Session at 122 Broadway Street with Mayor Trousil presiding. Council Members Hockett, Crowner, Johnson, Lees and Pilger were present. City Administrator Mandsager was absent. Building Inspector Hoy, Police Chief Walters and Public Works Director Fry were also present. Hockett moved, second by Pilger, to approve the Agenda as presented. Voice vote. All ayes. Motion carried.

    Lees moved, second by Hockett, to approve the Consent Agenda as presented. Voice vote. All ayes. Motion carried.

    COMMITTEE REPORTS:

    PUBLIC SAFETY – Lees reported the Fire Department is having a retirement party for Kenny Beenblossom who is retiring after 33 ˝ years of service to the Department. The open house is being held on Sunday, October 7th from 2:00 to 4:00. The Fire Department is also having a Pancake Breakfast on October 13.

    Police Chief Walters said the new police car is here. He is waiting for equipment to be installed before it is used.

    FINANCE - The Council agreed to conduct the City Administrator evaluation on October 8 after the Council Meeting. Mayor Trousil asked the Council Members to return their evaluations prior to October 1 at 5:00 p.m.

    STREETS – Council Member Johnson said the green light turning into the Mall is out. Public Works Director Fry said the seal coat project will start this week.

    SANITATION - Johnson said representatives of the Railroad and City Officials met with residents along Brushtown Road last week to discuss the proposed water and sewer projects. Mayor Trousil said the City has applied for a Community Development Block Grant for the sewer portion of the project. He said the City had been invited by the State to submit a full application for the project we proposed in the pre-application.

    UTILITIES – Council Member Crowner said the Council had received a report from Utility Billing Clerk Kelly Fry on the status of the Water Meter Replacement Program. He said 298 meters have been installed and they have appointments scheduled for more. The replacement program is going well.

    NEW BUSINESS:

    Consider Resolution of Support for the Families and Communities Affected by the Recent Terrorist Attacks – Mayor Trousil presented a Resolution of Support for the families and communities affected by the recent terrorist attacks that killed thousands of Americans, including husbands, wives, sisters, brothers, police officers and firefighters. He said we, the citizens of West Burlington, pledge to provide our support to New York City, Washington, D.C. and Summerset County, Pennsylvania.

    Lees moved, second by Hockett, to approve the Resolution of Support. Roll call. Ayes: Lees, Hockett, Crowner, Pilger and Johnson. Nays: None. Motion carried.

    Mayor Trousil said in light of the recent terrorist attacks which destroyed the World Trade Center in New York City and stuck and gravely damaged the Pentagon in Washington, D.C., the citizens of West Burlington desire to demonstrate our support for our fellow Americans through a monetary donation. He said thousands of civilians and hundreds of civil servants, firefighters and military personnel were killed in this devastating attack and thousands of American families are in mourning and financial despair as a result.

    Lees moved, second by Hockett, to approve a Resolution authorizing a check to the Iowa League of Cities in the amount of $3,161 which represents one dollar for every man, woman and child in the City of West Burlington, as counted in the 2000 Census. These funds will be sent to the Iowa League of Cities for distribution as part of an Iowa Gift to the victims of this great tragedy with our condolences as a demonstration of our support for our fellow Americans and this great nation. Roll call: Ayes: Johnson, Crowner, Pilger, Lees and Hockett. Nays: None. Motion carried.

    Consider Liquor License Application for The Barn – 701 Agency Road – Gary Hall 701 Harrison Avenue told the Council he wants to operate a business on Agency Street in West Burlington. He wants to sever sandwich type food and also have gaming tables (pool, darts, and pinball). He has applied for a beer and wine permit also.

    Mayor Trousil explained the application was sent to the Police Department, Building Inspector and Fire Department for review. The Police Chief recommended the City Council deny Mr. Hall’s application because he failed to complete the portion of the application that requested criminal history. He did not include OWI conviction in 1992. He also said Alcohol-related convictions raise a concern as to the quality of liquor control the city can expect from the licensee.

    Mr. Hall said he did not fill out the application himself; he had his insurance agent fill it out for him. He said he had not read the information in the application. He said he did not intentionally omit the information.

    After discussion Johnson moved, second by Crowner, to deny the liquor license application for Gary Hall to sell beer and wine at The Barn located at 701 Agency Road. Voice vote. Lees, Crowner and Johnson voted aye. Pilger and Hockett voted nay. Motion carried.

     

    Consider Sale of Fire Department Doors at Auction Barn – Mayor Trousil explained the doors at the Fire Station were recently replaced and the old ones need to be replaced. Johnson moved, second by Hockett, to approve the sale of Fire Department doors at the Auction Barn. Voice vote. All ayes. Motion carried.

    OLD BUSINESS:

    Consider Ordinance Amending the Zoning Regulations Concerning the Height of a Decorative Fence – Third Consideration – Hockett moved, second by Pilger, to approve the third consideration of an Ordinance amending the Zoning Code of the City concerning the height of a Decorative Fence. Roll call. Ayes: Lees, Crowner, Hockett, Pilger and Johnson. Nays: None. Motion carried.

    The amendment changes from five feet to four feet the height that a decorative fence may be used in any yard as determined by the "minimum front yard depth". It also states any decorative fence other than a split rail or picket fence made of wrought iron, wood or vinyl in the front yard shall require approval of the Board of Adjustment.

    CITIZEN’S INQUIRIES: Mrs. Willie Scott, Gear Avenue, asked the Council if she could put up no trespassing signs and no dumping signs on her property. Mayor Trousil advised her to contact her attorney.

    ADJOURN: There being no further business, the meeting adjourned at 6:12 p.m. upon motion by Lees, second by Hockett. Voice Vote: All Ayes. Motion carried.
