Regular Council Meeting August 28, 2001 – 7:00 P.M.
The West Burlington City Council met in Regular Session at 122 Broadway Street with Mayor Trousil presiding. Council Members Hockett, Crowner, Lees, Johnson and Pilger were present. City Administrator Mandsager and Building Inspector Hoy were also present. Lees moved, second by Hockett, to approve the Agenda as presented. Voice vote. All ayes. Motion carried.Lees moved, second by Pilger, to approve the Consent Agenda with the removal of ‘Payment to Des Moines County for Data Processing’ until clarified. Voice vote. All ayes. Motion carried.

STREETS – Mandsager reported he continues to work with Snyder and Associates on the Brushtown Road Project. He also reminded the Council of the meeting with the Danielson’s before the Council Meeting on September 11. He said he will meet on September 17 with Shive-Hattery and the IDOT to discuss the Farm King, GRMC Traffic Signal.
The Council agreed to conduct the Administrator Review on October 9.
NEW BUSINESS:
Consider Permit for Communication Tower for Burlington Trailways – Don Hastings and John Schneider with Electronic Applications and Ron Moore from Burlington Trailways told the Council they want to install a 47 foot communication tower at Burlington Trailways on Broadway Street. They have applied for a permit to install the tower, however they feel the chapter of the Municipal Code that regulates towers and antennas is too extensive and expensive. They asked the Council to waive the fee and omit the paperwork necessary for the application.
Administrator Mandsager explained Chapter 114 of the Municipal Code provides for the regulations and administration of the orderly location of antenna arrays and towers and it also sets out the application process for all applicants. He said the City has several reasons for instituting an ordinance such as this and minimizing the number of antennas and towers and ensuring proper location, design, and safety are but a few.
The Council Members felt the $500 fee was excessive for a tower of this height and after considerable discussion Hockett moved, second by Crowner, to reduce the fee from $500 to $130. Voice vote. Hockett and Crowner voted aye. Lees, Pilger and Johnson voted nay. Motion denied.
Johnson said he believes the Ordinance was adopted for a purpose and moved to leave the fee at $500. The motion died for lack of a second.
Pilger moved, second by Hockett, to reduce the fee to $250 for the permit for a Communication Tower for Burlington Trailways. Voice vote. Crowner, Hockett and Pilger voted aye. Lees and Johnson voted nay. Motion carried.
Consider Setting a Public Hearing and Letting on Proposed Plans and Specifications, Form of Contract, Estimated Costs and The Taking of Bids for the Proposed Sewer and Street Improvements – Wheeler Storm Sewer and Paving in the City of West Burlington – Hockett moved, second by Crowner, to approve a Resolution Setting a Public Hearing and Letting for Tuesday, September 11, at 7:00 p.m. on the Proposed Plans and Specifications, Form of Contract, Estimated Costs and the Taking of Bids for the Proposed Sewer and Street Improvements – Wheeler Storm Sewer and Paving in the City of West Burlington. Roll call. Ayes: Lees, Hockett, Crowner, Johnson and Pilger. Nays: None. Motion carried.
Consider Amendment to Engineering Services Agreement with French-Reneker – Wheeler and Glasgow Street Project – Administrator Mandsager said the City can make substantial savings with the storm portion of the project utilizing a polyethylene material for the storm sewers. And by including the final block of reconstruction on Wheeler the City can save additional time, effort and funding to the overall project. This amendment allows for survey work and drawings related to the acquisition of necessary right-of-way and for the additional engineering necessary to include the additional block of street work to the project.
Hockett moved, second by Crowner, to approve an amendment to the Engineering Services with French-Reneker to cover additional services for the Wheeler Street Storm Sewer and Paving Project. Voice vote. All aye. Motion carried.
Consider Payment to French-Reneker Engineers – Wheeler and Glasgow Street - $7,545.33 – Lees moved, second by Hockett, to approve payment in the amount of $7,545.33 to French-Reneker Associates for engineering services on the Wheeler and Glasgow Street Project. Voice vote. All ayes. Motion carried.
Consider Design and Coloring for Signs for Longmeadow Park – Lees moved, second by Pilger, to approve purchasing signs for Longmeadow Park. There will be two rules signs, one Arthur playground safety sign, one welcome sign with the West Burlington Logo and two large entry signs. The City will also purchase one sun dial if there are sufficient funds. Voice vote. All ayes. Motion carried.
Consider Contract with Southeast Iowa Regional Planning Commission to Update the City’s Comprehensive Plan – Lees moved, second by Johnson, to table the contract with Southeast Iowa Regional Planning Commission to update the City’s Comprehensive Plan. Voice vote. All ayes. Motion carried.
Mayor Trousil encouraged each Council Member to review the Comprehensive Plan and make recommended changes to the Planning Commission.
Consider Placement of Traffic Warning Signs on N. Gear Avenue – Mayor Trousil explained the City received a letter from LaVeine Sanitation requesting the placement of signs on N. Gear Avenue. They said there is considerable traffic on North Gear and traffic entering or exiting driveways or moving south on N. Gear creates a danger. They feel sings indicating hidden drive or trucks entering and exiting roadway could be beneficial. Police Chief Walters said he recommends the Council approve the placement of traffic warning signs for both north and south bound traffic that reflects the awareness of driveways on this blind curve.
Crowner moved, second by Hockett, to approve placing traffic warning signs for both north and south bound traffic on North Gear Avenue in the 1000 block. Voice vote. All ayes. Motion carried.
OLD BUSINESS:
Consider Final Draft of Commercial and Residential Development Agreements with Shottenkirk – Administrator Mandsager said the commercial and residential TIF agreements had been modified to include the issues the Council indicated at the last Council Meeting. He said the attorney who prepared the documents, Robert Josten with Dorsey and Whitney, had included some additional clarifying language to several portions of the document, such as adding the bank into the document for further security on the City’s part.
Lees moved, second by Pilger, to approve the Development Agreements for Commercial and Residential development for Shottenkirk Partnership L.P. Voice vote. Lees, Pilger and Crowner voted aye. Johnson and Hockett voted nay.
Consider Ordinance Amending the Zoning Regulations Concerning the Height of a Decorative Fence – Lees moved, second by Pilger, to approve the first consideration of an Ordinance amending the Zoning Code of the City concerning the height of a Decorative Fence. Roll call. Ayes: Lees, Crowner, Hockett, Pilger and Johnson. Nays: None. Motion carried.
The amendment changes from five feet to four feet the height that a decorative fence may be used in any yard as determined by the "minimum front yard depth". It also states any decorative fence other than a split rail or picket fence made of wrought iron, wood or vinyl in the front yard shall require approval of the Board of Adjustment.
