Regular Council Meeting May 29, 2001 – 7:00 P.M. The West Burlington City Council met in Regular Session at 122 Broadway Street with Mayor Trousil presiding. Council Members Hockett, Pilger, Crowner, Lees, and Johnson were present. City Administrator Gregg Mandsager, Fire Chief Bill Astfalk and Building Inspector Hoy were also present. Lees moved, second by Pilger, to approve the Agenda as presented. Voice vote. All ayes. Motion carried.

    CITIZEN’S INQUIRIES: There were none.

    PUBLIC HEARING: Budget for Fiscal Year 2001 – Mayor Trousil opened the Public Hearing on the Budget Amendment for Fiscal Year 2001. He said the Budget Amendment is in the amount of $2,185,693 that consists mostly of Capital Projects. There were no comments from the Council or from those present. The Public Hearing was closed.

    Approve Resolution Amending Budget for FY 2001- Lees moved, second by Crowner, to approve a Resolution amending the Budget for Fiscal Year 2001. Roll call. Ayes: Lees, Crowner, Hockett, Pilger and Johnson. Nays: None. Motion carried.

    NEW BUSINESS:

    Consider Purchase of Motorola Minitor III Pagers - $2,430 – Lees moved, second by Johnson, to approve the purchase of six Motorola Minitor III Pagers at a cost of $2,430. Voice vote. All ayes. Motion carried.

    Consider Funding of West Burlington School Project – The Council had met earlier in the month with West Burlington School Superintendent Jim Sleister to discuss a contribution to the West Burlington School District. The School is in a TIF District and TIF Funds have been used in the past for school improvements. The school district will need to raise taxes this year. It appears the TIF district is costing the school somewhere between $6,000 and $70,000 in property taxes. Administrator Mandsager said there are other variables that must be considered as well, i.e. lost valuation, location of the school district, number of students/growth/open enrollment, school budget and school debts. Many of these factors the City does not have any control over. Mandsager said he does not see how the City can tie a contribution to the school system’s levy – there are too many factors that are out of our control and if we assume a continued 4% student growth then we would contribute $70,000 this year, $140,000 next year, and so on. He reminded the Council to remember the benefits that the TIF district bring to our community and at the same time consider a school request for city contributions toward a capital project as it goes hand in had with the school’s original consent to the establishment of the TIF district.

    Sleister said the school is working on a roof replacement project that they expect to take 5 years to complete and cost one half million. Hockett said the City has worked well with the school in the past and hopes that practice will continue. He recommended contributing $70,000 in TIF revenue to the school district. Johnson said he does not believe the City should commit to a 5-year project. He said annual contributions should be considered. Sleister reminded the Council that school taxes will go up if valuations don’t increase.

    Hockett moved, second by Johnson to contribute $70,000 to the West Burlington School for the Fiscal Year 2001-2002 in order to prevent the school from raising taxes. Voice vote. All ayes. Motion carried.

    Consider Hiring Part-Time Summer Employee for Swimming Pool – Administrator Mandsager recommended the Council approve hiring Ali Noller as Assistant Pool Manager. Noller is available to start immediately and will also be available to lifeguard and teach swim lessons as well.

    Lees moved, second by Hockett, to hire Ali Noller as Assistant Pool Manager and receive $8.68 per hour. Voice vote. All ayes. Motion carried.

    Consider Payment to French-Reneker-Associates for Engineering Services – Clerk Simonson presented two invoices from French-Reneker for engineering services. The first is for reconstruction of Leffler and Pennington in the amount of $2,925.61. The second is for Wheeler and Glasgow Streets in the amount of $12,962.17. The City has contracts for each of these projects.

    Lees moved, second by Crowner, to approve payment to French-Reneker-Associates for Engineering Services in the amount of $15,887.78.

    Consider Purchase of Project Costing Software - $1,500 – Hockett moved, second by Pilger, to approve the purchase of Project Costing System Software from CMS in the amount of $1,500. Voice vote. All ayes. Motion carried.

    Consider Purchase of Computers for City Hall – Administrator Mandsager explained the City Budgeted for three new computers for City Hall for the Fiscal Year 2002 Budget. He said we are exploring the possibility of not purchasing a new computer for the Utility Billing Clerk. But rather utilizing the laptop that was purchased with the new metering system. Some additional accessories for the laptop would be needed but the expense would be considerably less than a new computer. Mandsager said City Accountant Sattler obtained costs for a laptop for the City Clerk that could also be used at council meetings and a desktop for the City Accountant. The cost for these two computers is $4,703. The total budgeted for computers is $5,800.

    Crowner moved, second by Johnson, to approve the purchase of two new computers in the amount of $4,703. Voice vote. All ayes. Motion carried.

    Consider Purchase of Signs and Equipment for Longmeadow Park – Administrator Mandsager presented cost estimates for six signs for Longmeadow Park, two signs for rules and playground safety, two entry sings, and two archway entry signs for the two main entrances to the park. He said he would be working with the sign company to design the signs. He asked the Council to approve the purchase stating he will provide them a draft of the sign before the final order is placed. Mandsager said following this purchase there are only minor items left to complete the park.

    Hockett moved, second by Lees, to approve the purchase of signs for Longmeadow Park at a cost estimate of $8,795. Johnson said he would like to see the design before the final decision is made to purchase. Voice vote. All ayes, except Johnson who voted nay. Motion carried.

    OLD BUSINESS:

    Consider GIS 28E Agreement – Administrator Mandsager said he met with David Miller, Pat Jackson, Bruce Slagle and Ron Kanoke regarding the 28E for GIS and they prepared an agreement for each entity’s approval. He said Phase One of the agreement states West Burlington would be responsible for 15% of the cost within the City limits necessary to get the GIS up and running before we begin to add additional layers. These are also items that are available on CMS and can be basically dumped into the new system. Mandsager said the cost estimated for phase one cannot be determined exactly until a vendor is chosen and can narrow down what portion is within the City Limits and is due as our share. They estimate the total costs for phase one are between $257,000 and $336,000 and Burlington’s actual costs are likely under $50,000 and our cost is closer to $20,000.

    Mandsager said Phase Two states each governmental body would be responsible for additional layers that they would like to have added to the base system.

    Additionally he said maintenance for the GIS system will be the ongoing expenses incurred to maintain the system. This would include a GIS Coordinator and likely a shared support person. They estimate maintenance costs to run between $80,000 and $100,000 per year. Of this amount the City of West Burlington would be responsible for $12,000 - $15,000 per year or 15%. Hockett said he is opposed to hiring a new employee to maintain the system. He said no one has told him what the workload will be. He also objects to the 5-year clause in the contract. He believes it should be one-year terms.

    Hockett moved, second by Crowner to approve the GIS Agreement that includes changing the term from five years to one year. The City Administrator or his/her designee will be the representative to the Commission Voice vote. All ayes. Motion carried.

    Consider Engineering Agreement for Brushtown Road – Administrator Mandsager said the Council approved hiring Snyder and Associates to perform the preliminary phase of work for the Brushtown area. He said at that time BNSF agreed to pay a maximum of $10,000 for that work. He said there have been some modifications to the agreement that include survey work needed to determine property lines. Also the contract is for a maximum not to exceed $21,345 and our letter with BNSF is for a maximum of $10,000 for the initial phase. He said we need additional assurances from BNSF before we can contract for this amount.

    Hockett moved, second by Johnson, to approve contracting with Snyder and Associates for engineering work for the Brushtown Road Project pending receipt of assurance from BNSF for additional fees. Voice vote. All ayes. Motion carried.

    Consider Second Consideration of Ordinances Amending the Electric Code; Uniform Mechanical Code, International Plumbing Code and the Uniform Building Code – Lees moved, second by Crowner, to approve the Second Consideration of Ordinances amending the Electric Code, Uniform Mechanical Code, International Plumbing Code and the Uniform Building Code. Roll call: Ayes: Hockett, Crowner and Lees. Nays: Pilger and Johnson. Motion passed.

    COMMITTEE REPORTS:

    STREETS – Gear Avenue and Mt. Pleasant Street Traffic Study – Administrator Mandsager said it is time to decide what to do with the intersection of Gear Avenue and Mt. Pleasant Street. A Work Session will be determined and the Council will be notified. It was the census of the Council Members to hold the Work Session on a night other than a Council Meeting.

    SANITATION – Mandsager said there are about three items left to be completed on the Wastewater Treatment Plant Project. It will hopefully be completed this fiscal year.

    UTILITIES – Mandsager said during construction of the Beaverdale Intersection is the time to put in a casing if the City ever intends to extend utilities to the Beaverdale area. He will get cost estimates and designs for the Council to consider.

    PUBLIC SAFETY – Council Member Lees said the D.A.R.E. Graduation is Friday at the Elementary School.

    FINANCE - Update on Airport Authority – Hockett said he understands the City of Burlington is planning to borrow money to provide the matching funds for a Federal Grant for the Airport. He wants to make sure the City of West Burlington is not responsible for the repayment of the debt. He said an agreement should be developed placing the liability on Burlington.

    Building Permit Requirement for Siding Replacement –Hockett said in order to encourage existing residents to improve their property; he wanted the Council to consider eliminating the building permit requirement for siding. He said the City does not require a permit for roof replacement when load-bearing walls are not affected. Hockett asked for this item to be added to this Agenda. It was the census of the Council Members to consider this after the final reading of the Building Code Ordinance.
