Regular Council meeting April 10, 2001 – 7:00 P.M. The West Burlington City Council met in Regular Session at 122 Broadway Street with Mayor Trousil presiding. Council Members Hockett, Crowner, Lees, and Johnson were present. Council Member Pilger was absent. City Administrator Gregg Mandsager, Public Works Director Randy Fry, Police Chief Gary Walter, Fire Chief Bill Astfalk and Building Inspector Hoy were also present. City Clerk Terrie Simonson was absent. Lees moved, second by Crowner, to approve the Agenda. Voice vote. All ayes. Motion carried.

    Lees moved, second by Crowner, to approve the Consent Agenda as presented. Voice vote. All ayes. Motion carried.

    CITIZEN’S INQUIRIES: No inquiries were received.

    PRESENTATION: Bill Cary – Leland Belding - Shive-Hattery Engineers –

    Update on Traffic Signal Projects - Bill Cary and Leland Belding with Shive-Hattery presented a master plan and construction update for Gear and Agency. A brief history of the project beginning three years ago and ending with the hope that we can complete the Master Plan in the next 1 ½ years. The Iowa DOT approved the city’s $105,000 safety grant for the intersection of Mt. Pleasant and Gear. Mr. Cary highlighted City Staff assistance with the funding request. Finally, Shive is recommending that the City combine our three signal projects (Mt. Pleasant and Gear, Farm King, and SCC/GRMC) into one bid letting and contract to save cost and time. Mr. Belding followed up this update with a review of current projects as described in the handout/timeline provided to Council.

    Change Order for Gear Avenue Division 2 Traffic Signal Project - Prior to discussion of the proposed change order, Council engaged in a brief discussion of the proposed interim redesign of the lanes East on Agency. Council Member Lees asked for detail as to marking for four versus five lanes on Agency. According to Shive, the lanes had to line up with the lanes directly across the intersection and specifically the turn lanes. Additionally, all present marking and any changes we make in the next year or so are only temporary. The final lane markings will be down when the fifth lane is extended to the East to Wal-Mart. As for the change order, Councilman Johnson pointed out that there was a maintenance bond on the pavement markings as water based paint was substituted for epoxy. Shive is going to review the file and prepare the letter to have Shipley repainted the project. The Agency restriping will still be at City expense with 55% IDOT match.

    Agency Road Widening – STP - Shive recommends proceeding with the Agency Road Widening due to the time it will take to bring the project to bid and if perchance the funding came open sooner, then the City would be prepared to move ahead.

    NEW BUSINESS:

    Consider Payment to Shive-Hattery for Engineering Fees - Lees moved, seconded by Hockett to approve the payment to Shive-Hattery for engineering services for two projects. $3,204.50 for the GRMC/SCC Traffic Signal and $3162.65 for Gear Avenue Division I Construction Services. Voice vote. All Ayes. Motion carried.

    Consider Purchase of New Vehicle for Police Department - Lees moved seconded by Hockett, to purchase a new vehicle for the police department. Chief Walters recommended the purchase of a 2001 Chevrolet Impala from Deery Brothers in the amount of $18,967.98. Chief Walters noted that the City budgeted $19,500 for the vehicle and further noted that the City was having additional problems with the Dodges. Voice vote. All ayes. Motion carried.

    Consider Resolution of Support and Commitment for Hwy 34 Corridor Study - Johnson moved, seconded by Lees, to provide the SEIRPC a letter of support for the Highway 34 Corridor Study and to commit to providing $500 for the study. Discussion: Councilman Crowner noted area support for the study and thought the City of West Burlington should follow suit, but noted a need for improved performance on the part of the Commission staff. Voice vote. All Ayes. Motion carried.

    Consider Purchase of Trees for Longmeadow Park - Crowner moved, seconded by Lees, for the purchase and planting of trees in the amount of $9,156 from Carters for Longmeadow Park. It was noted that Stineman had worked with Carter’s prior to this and that the trees should be in line for Longmeadow Park. Council Member Lees asked if the areas surrounding the Park shelters could be sodded rather than planted. Councilman Hockett noted that the area could be planted with rye grass and it would be up in a short time. Voice vote. All ayes. Motion carried.

    Consider Request from Richard Broeg for Extension of Building Deadline in Pleasant Meadow Subdivision - Johnson moved, seconded by Hockett, to support a request by Richard Broeg to extend his building deadline in Mt. Pleasant Subdivision until November 1, 2001, for Lot #5. Discussion followed as to what constituted "starting construction" and it was the consensus that a building permit was necessary and actual construction could be considered from laying a basement versus simply digging. Voice vote. All ayes. Motion Carried.

    OLD BUSINESS:

    Consider an Ordinance on Third Reading Adding Definition of "Durable Hard Surface" to the Zoning Code - Hockett moved, seconded by Johnson, to approve the third reading of an ordinance adding the definition of "Durable hard Surface" to the zoning code. No discussion. Roll Call: Hockett – aye, Crowner – aye, Lees – aye, Johnson – aye, Pilger – absent. Motion carried.

    Consider an Ordinance on Second Reading Concerning the Rear Yard Depth in a B-1 District - Hockett moved, seconded by Johnson, to approve the Second Reading of an ordinance concerning changing the rear yard depth in a B-1 District from 35 to 20 feet when adjoining a Residential District. No discussion. Roll Call: Hockett – aye, Crowner – aye, Lees – aye, Johnson, aye, Pilger absent. Motion carried.

    Building Inspector Hoy recommended that the Council waive the third reading. Lees so moved and Johnson seconded. Roll Call: Hockett – aye, Crowner – aye, Lees – aye, Johnson, Aye, Pilger – absent. Motion Carried.

    COMMITTEE REPORTS:

    Utilities - Councilman Crowner reported on Kelly Fry’s water meter report. Randy Fry reported on the Mt. Pleasant and Gear leak near the overpass and the water shutoff on Tuesday, April17, 2001.

    Public Safety - Fire Chief Astfalk reported on two recent meetings – one with the Sheriff’s Department on water rescue and a second with dispatch.

    Finance - Councilman Hockett noted that city staff should prepare a resolution to lower the minimum water usage/rate and an ordinance to remove the automatic 5% water rate increase annually. Second Mandsager reported that Public Works would be starting Longmeadow sidewalks this coming week and that he and the fire chief were working on a federal grant worth up to $750,000 for the department.

    Streets - Consider Approval of Seasonal Help - Public Works Director Fry recommended the hiring of Bob Bence starting Monday, April 16, 2001,

    Sanitation - No report.

    Proclamation: Burlington/West Burlington Area United Way Time – Mayor Trousil proclaimed April 22-28 as Youth Appreciation Week in the City of West Burlington and April 19, 2001 as Clean Out Your Files Day.

    Mayor’s Inquiries:

    Mayor Trousil made a brief presentation on the recent regional trip to D.C. to meet with our area Congressmen and staff and present issues important to the region as a whole. Overall the trip was a success. Mandsager reported on the three city-specific issues that were brought before the Congressional staff as well.
