Regular Council Meeting March 13, 2001 – 7:00 P.M.
The West Burlington City Council met in Regular Session at 122 Broadway Street with Mayor Trousil presiding. Council Members Hockett, Crowner, Lees, Johnson and Pilger were present. City Administrator Mandsager, Fire Chief Astfalk and Police Chief Walters were also present. Lees moved, second by Johnson, to approve the Agenda as presented. Voice vote. All ayes. Motion carried.Lees moved, second by Pilger, to approve the Consent Agenda as presented. Voice vote. All ayes. Motion carried.

PUBLIC HEARING: Definition of "Durable Hard Surface"
Mayor Trousil opened the Public Hearing concerning adding the definition of "Durable Hard Surface" to the Zoning Code. Steve Swafford told the Council if the City is going to continue to sealcoat streets how can they require citizens to put in concrete or asphalt on their private driveways. He said Raider’s has expanded their parking area in the last 6 months and they have not made it dust free.
Mayor Trousil explained that this really is not an enforcement issue. The Zoning Code mentions durable hard surface in the content but it is not defined. The purpose of this ordinance is to add the definition. There were no other comments.
Approve an Ordinance on First Consideration adding Definition of "Durable Hard Surface" to the Zoning Code - Hockett moved, second by Pilger, to approve the first consideration of an ordinance adding the definition to "Durable Hard Surface" to the Zoning Code. Roll call. All ayes. Motion carried.
NEW BUSINESS:
Consider IDED Rural /Community Grant Application for Market Analysis – Administrator Mandsager explained John Danielson and McClure Engineering asked to speak to the Council tonight concerning the application for an IDED Rural/Community Grant that would help the City and other public entities secure $50,000 for a marketing study that would include the Danielson property, but would also focus on other areas of development within the City, County and even including IAAP and different needs that they identify such as waste water.
Howard Johnson with McClure Engineering Co. explained there is a $25,000 grant match. He said he has corresponded with the other entities and they are interested in participating in the market analysis. He said it would require a financial commitment from all of them including the City. Johnson estimated the City’s share would be $10,000.
The Council agreed they are extremely interested in seeing development of the Danielson property but they feel the Danielson’s should make a financial commitment also. Danielson said he could commit to a deferred payment.
After discussion the Council agreed they do not have enough information to make an informed decision at this time. Lees moved, second by Pilger, to table this consideration until more information is obtained. Voice vote. All ayes. Motion carried.
Consider Engineering Services Agreement for:
Five-Year Street Improvement Plan – Administrator Mandsager presented a proposal from French-Reneker-Associates for a five-year street improvement plan that will identify the streets needing reconstruction, resurfacing, or rehabilitation in the next five years. The type of improvement and a cost estimate will be provided for the identified streets along with a map of each identified area. Administrator Mandsager said the plan will be a great benefit as we go through our budgeting and capital planning. The agreement amount is $6,900 with a September 1 completion date estimated.
Hockett moved, second by Johnson, to approve an engineering agreement with French-Reneker-Associates in the amount of $6,900 to complete a five-year street improvement plan. Voice vote. All ayes. Motion carried.
Reconstruction of Leffler and Pennington – Administrator Mandsager presented a proposal from French-Reneker-Associates for the engineering services for the reconstruction of Leffler and Pennington. This project was identified during the budget process. The agreement amount is $22,800 with a June bid date.
Hockett moved, second by Pilger, to approve an engineering services agreement with French-Reneker-Associates in the amount of $22,800 for the reconstruction of Leffler and Pennington Streets. Voice vote. All ayes. Motion carried.
Consider Upgrading Police Department Software – Lees moved, second by Pilger, to approve an upgrade for the Sleuth software used by the Police Department. The upgrade includes additional training. The estimated cost to the City of West Burlington is $2,000. Voice vote. All ayes. Motion carried.
Consider Payment to Shive-Hattery for Engineering Services for Borghi Pretreatment Agreement – Administrator Mandsager explained the new Borghi Plant in the Business Park will require a pretreatment agreement for their metals effluent. He hired Shive-Hattery to perform the necessary review. The cost exceeded $1,000. Crowner moved, second by Johnson, to approve payment to Shive-Hattery in the amount of $1,029. Voice vote. All ayes. Motion carried.
Consider Pretreatment Agreement with Borghi USA Inc. – Crowner moved, second by Johnson, to approve the pretreatment agreement with Borghi USA, Inc. Voice vote. All ayes. Motion carried.
Consider Pay Application for Division 2 – Traffic Signal Improvements – KWS Inc. – Crowner moved, second by Pilger, to approve payment to KWS Inc. for Traffic Signal Improvements in the amount of $2,553.60. Voice vote. All ayes. Motion carried.
Consider Speed Regulations on Division Street – Mayor Trousil explained the City has not set a speed limit on Division Street. Division Street in Burlington from Roosevelt Avenue to West Burlington Avenue is 30 MPH and from West Burlington Avenue to the Burlington/West Burlington City Limits is 35 MPH.
Hockett moved, second by Crowner, to approve the first consideration of an Ordinance setting the speed limit on Division Street at 35 MPH. Roll call. Ayes: Lees, Crowner, Hockett, Johnson and Pilger. Nays: None. Motion carried.
Consider Solid Waste Contract with LaVeines Sanitation – Mayor Trousil said the Municipal Solid Waste Disposal Contract with LaVeines Sanitation expired July 1, 2001. LaVeines have agreed to continue garbage collection in West Burlington for the next three years for a price increase of 5% for the next two years and 2% the third year.
Lees moved, second by Johnson, to approve a contract with LaVeines Sanitation Services for municipal solid waste collection. All ayes. Motion carried.
Consider Pay Application for Wastewater Treatment Plant – Carl A. Nelson – Hockett moved, second by Lees, to approve payment to Carl A. Nelson Company for work completed on the Wastewater Treatment Improvements Project in the amount of $36,374.05. Voice vote. All ayes. Motion carried.

COMMITTEE REPORTS:
SANITATION – Chad Lambi from Shive-Hattery will be at the next Council Meeting to discuss the new Wastewater Treatment Plant.
UTILITIES - Administrator Mandsager said Public Works was working to correct a water leak on the main that provides water to customers in the western part of town. He said it is the new main that was installed near the street construction taking place on Mt. Pleasant Street. Wunderlich assisted the City in December with the emergency connection. They are attempting to discover the problem.
PUBLIC SAFETY – Consider Job Description for Firefighter – The Council reviewed a copy of a Job Description for Firefighters. They agreed it should be placed on file with the remainder of job descriptions that are on file in the City Clerk’s Office.
FINANCE
– There was nothing to report.STREETS - It was reported the speed limit sign on Broadway from Agency to Division Street is missing and that the street near 402 E. Pennington Street is falling apart.
CITIZEN’S INQUIRIES
: There were none.CLOSED SESSION: To Discuss the purchase of particular real estate only where premature disclosure could be reasonably expected to increase the price the governmental body would have to pay for that property: Lees moved, second by Pilger, to go into Closed Session in accordance with Chapter 21.5(j) of the Code of Iowa. Roll call. Ayes: Lees, Crowner, Johnson, Pilger and Hockett. Nays: None. Motion carried.
The Closed Session ended at 9:52 p.m.
