Regular Council meeting November 28, 2000 7:00 P.M.
The West Burlington City Council met in Regular Session at 122 Broadway Street with mayor Trousil presiding. Council Members Hockett, Crowner, Lees, Pilger and Johnson were present. City Administrator Gregg Mandsager, Public Works Director Randy Fry, Police Chief Gary Walters and Fire Chief Bill Astfalk were also present. Lees moved, second by Pilger, to approve the Agenda as presented. Voice vote. All ayes. Motion carried.Lees moved, second by Pilger, to approve the Consent Agenda as amended. Voice vote. All ayes. Motion carried.

NEW BUSINESS:
Consider Payment to Carl A. Nelson Company Wastewater Treatment Improvements - $47,736.46
Lees moved, second by Johnson, to approve payment to Carl A. Nelson Company in the amount of $47,736.46 for work completed to date on the Wastewater Treatment Improvements. The amount includes a $2,365.00 change order for an additional electrical breaker and also a $263.00 change order for one additional lagoon aerator that was installed early in the project. Change orders total $6,654.00 to date. Voice vote. All ayes. Motion carried.Consider Payment to Alliant Energy for LED lights - $24,092.04 Lees moved, second by Pilger, to approve payment to Alliant Energy in the amount of $24,092.04 for LED lights for the traffic signal project on gear and Agency Streets. Voice vote. All ayes. Motion carried.
Consider Purchase of Analytical Balance for Wastewater Plant - $2,697.78 Johnson moved, second by Pilger, to approve the purchase of Analytical Balance from Fisher Scientific Company in the amount of $2,697.78 for the Wastewater Treatment Plant. Voice vote. All ayes. Motion carried.
Consider Purchase of EMS Training Aid - $1,042.49 Lees moved, second by Johnson, to approve the purchase of a "Kelly Intubation Torso" for EMS certifications for the Fire Department in the amount of $1,042.49 plus shipping. Voice vote. All ayes. Motion carried.
Consider Purchase of Real Estate Pilger moved, second by Lees, to approve the purchase of property located at 121 Swan Street and belonging to David and Teresa Wagner in the amount of $90,000. Voice vote. All ayes, except Hockett who voted nay. Hockett stated the reason he voted nay was because he believes the City should use the property the City owns on Pleasant Street for a new City Hall. Motion carried.
OLD BUSINESS:
Consider Contract Amendment Wastewater Treatment Plant Project Chad Lambi with Shive-Hattery explained an amendment was necessary for the Wastewater Treatment Plant Project because the contract was based on their 1996 fee and the project has lasted far longer than anticipated. The average rate of the typical engineer working the project went from $54.75 to $65.25. Lambi said this reflects a 2.6 percent annual increase in fees that totals $14,500.
Lees moved, second by Crowner, to approve an amendment to the Engineering Contract with Shive-Hattery for the Wastewater Treatment Plant in the amount of $14,500. Voice vote. All ayes. Motion carried.
Consider Ordinance on Second Reading - Minimum Lot Width in Residential Districts Hockett moved, second by Johnson, to approve an ordinance on second reading concerning minimum lot width in Residential Districts. Lots for residence purposes, other than cul-de-sacs, shall be at least fifty feet wide at the front lot line. Roll call. Ayes: Hockett, Crowner, Lees, Pilger and Johnson. Nays: None. Motion carried.
Consider Zoning Code Amendment Height of a Decorative Fence in Front Yard Council Member Hockett explained he had asked for this ordinance amendment, regulating the height of a decorative fence in a front yard, because of the incident that occurred a couple weeks ago. He said he thinks technology has out-dated our code. Hockett recommended allowing a decorative fence of three and one-half (3 ½) feet in height above grade level when used in a front yard as determined by the "minimum front yard depth". The current code allows for three (3) feet in height.
The Council agreed the proposal should be sent to the Planning and Zoning Commission for review. Lees moved, second by Hockett, to ask the Planning and Zoning Commission to review the Code concerning a Decorative Fence in a front yard. They agreed P & Z should look at the design of the fence not the material. Voice vote. All ayes. Motion carried.
COMMITTEE REPORTS
:SANITATION There was nothing to report.
UTILITIES Administrator Mandsager explained Public Works Director Fry had obtained two quotes for lowering the water main along Mt. Pleasant Street that provides water to the Beaverdale area. This portion of the main was exposed during construction of the Highway 34 interchange. The main needs to be lowered about six (6) feet. Fry said Wunderlich quoted the lowest price, $7,300. He said Wunderlich will provide the equipment and the City will provide the manpower. The project should take about a week. Notices will be sent to residents in the Beaverdale Area to tell them about the project and that they will be without water for a portion of a day when the connection is made.
PUBLIC SAFETY Council Member Lees said she is able to attend the meeting with George Oster of the Iowa State University Fire Service Institute on Monday, December 11, at 4 P.M. at City Hall.
FINANCE - City Clerk Simonson said she met with Kathryn Henning with Dunbar Jones who is working with city staff to complete a transportation enhancement grant application for the bike trail. The application needs to be filed by December 22. Ms. Henning will be assisting city staff in completing the application. The application will be presented to Council for final approval.
STREETS Administrator Mandsager said he is working with Alliant to get cost estimates on light poles for Agency Street.
CLOSED SESSION: To Discuss purchase of particular real estate only where premature disclosure could be reasonably expected to increase the price the governmental body would have to pay for that property - Johnson moved, seconded by Lees, to go into closed session in accordance with Chapter 21.5 (j) of the Code of Iowa. Roll call. Ayes: Lees, Crowner, Johnson, Pilger and Hockett. Nays: None. Motion Carried.
The Closed session ended at 9:00 P.M.
There being no further business the meeting adjourned at 9:05 p.m. upon motion by Hockett and second by Lees. Voice vote. All ayes. Motion carried.
