Regular Council Meeting April 13, 1999 - 6:00 P.M.   The West Burlington City Council met in Regular Session at 122 Broadway Street with Mayor Trousil presiding.  Council Members Hockett, Lees, Johnson, Riessen, and Pilger were present. City Administrator Plyman, Police Chief Walters, Building Inspector Hoy and Fire Chief Astfalk were also present.   Lees moved, second by Riessen, to approve the Tentative Agenda as presented.  Voice vote.  All aye.  Motion carried.

    Lees moved, second by Johnson, to approve the following Consent Agenda items:

    BID OPENING FOR PLEASANT MEADOW SUBDIV. LOTS - AWARD TO HIGHEST  BIDDER – Mayor Trousil announced a bid had been received for Lot #11 in Pleasant Meadow Subdivision.  Richard Broeg bid $12,500 for the lot.  His bid was accompanied with a bid bond in the amount of $1,250.    Pilger moved, second by Johnson, to accept the bid in the amount of $12,500 from Richard Broeg for Lot #11 in Pleasant Meadow Subdivision.  Voice vote.  All aye.  Motion carried.

    CITIZEN’S INQUIRIES: There were none.

    NEW BUSINESS:

    Consider Amended and Substituted Water Purchase Agreement with Beaverdale Area Subdivisions – Administrator Plyman explained the City has been selling water to three Beaverdale area subdivisions since 1989 pursuant to a contract.  Subdivision representatives and city officials have been

    Negotiating changes to the contract for the past year. 

    Several representatives from the various subdivisions were present at the meeting.  Both the City attorney and the Subdivision’s attorney had reviewed the agreement prior to the meeting.

    After discussion Hockett moved, second by Lees, to approve the amended and substituted water purchase agreement with Beaverdale area subdivisions which includes correcting a typographical error in section 6, which states bills not paid by the fifteenth day of the month will incur a 10% penalty.  Voice vote.  All aye.  Motion carried. 

    Consider Sidewalk Reimbursement Policy – Lees moved, second by Pilger, to continue the past two years’ policy for reimbursing residents for sidewalk replacement.  The reimbursement amount is $11.04 per square yard or $4.91 per linear foot.  Voice vote.  All aye.  Motion carried.

    Consider Resignation of Police Officer Gary Franklin – Administrator Plyman explained Officer Franklin is seeking to resign early from the West Burlington Police Department and has asked the City to approve the payment of unused sick leave.  He said employees under the union contract are not automatically entitled to such a payment.  However, it appears that Officer Franklin may be able to make a claim for sick leave.  Therefore, he said, a lump sum payment and early resignation merely accelerates the cash payment and doesn’t increase the total amount.  He also said the early resignation would allow the City to begin the steps necessary to fill the vacancy.  This will reduce the overtime cost that the City incurs during such vacancies. 

    After discussion, Hockett moved, second by Lees, to accept Officer Franklin’s resignation from the West Burlington Police Department and affirm the payment for unused sick leave.  Voice vote.  All aye.  Motion carried.

    Consider Creating a City Accountant Position – Administrator Plyman explained Leslie Sattler is currently handling the City’s accounting functions.  She has held the position of “Accounting Clerk” since being hired in 1995.  Sattler has excelled in her work and is capable of performing more sophisticated accounting and investment duties.  Sattler has a Bachelor of Science degree from Iowa Wesleyan College with double majors of Accounting and Business.  She has also taken a class in Windows NT and intends to take additional classes in computer networking.  She has become a valuable asset to the City.   Plyman said he and Clerk Simonson recommend creating a City Accountant position and promoting Sattler to the position. 

    Hockett moved, second by Riessen, to approve Resolution 99-11 setting the salary for City Accountant, Leslie Sattler at $33,150.00 effective April 12, 1999.  Roll call.  Ayes:  Lees, Pilger, Johnson, Riessen, Hockett.  Nays:  None.  Motion carried.

    Consider Purchase of Real Estate and Change Order – Mt. Pleasant Street Frontage Road

    Mayor Trousil said Harold Wolfe has accepted the City’s offer of $15,000 for the land that we need to extend the frontage road across his property.  By doing so the City can now extend the frontage road as originally planned.  Engineer John Meyer asked Mike Nelson Concrete Paving if they would agree to a change order with the same unit prices but using higher quantities to reflect the longer road.  They agreed.  A change order in the amount of $31,085.74 will need to be approved. 

    Lees moved, second by Riessen, to approve the purchase of real estate from Harold Wolfe for the extension of the Mt. Pleasant Street right-of-way at a cost of $15.000 and a Change Order (No. 1) on the Mt. Pleasant Street Frontage Road project at a cost of $31,085.97.    Voice vote.  All aye.  Motion carried

    OLD BUSINESS:

    Consider Ordinance on Third Reading Concerning Surcharges on  Certain Sanitary Sewer Customers - Hockett moved, second by Lees, to approve an ordinance on third reading amending Chapter 99 of the Municipal Code concerning special rates imposed on certain sanitary sewer customers.  Roll call.  Ayes:  Lees, Pilger, Johnson, Hockett, Riessen.  Nays:  None.  Motion carried.

    COMMITTEE REPORTS:

    SANITATION – Plyman explained the City received the DNR permit to upgrade the south lift station.  He said we will be going out for bids soon. 

    Plyman said we received Shive-Hattery’s preliminary engineering report concerning the IAAP Connection study.  He said the report recommends against further measures to control I&I in IAAP’s sewers.  A copy of the report will be prepared and distributed.

    UTILITIES – Plyman said he, along with staff members, is investigating a water meter replacement program.  The new meter system would eliminate customers reading their own meters.  A remote system would be instituted.  He will report more as the investigation proceeds. 

    PUBLIC SAFETY – Lees said the Great Graduation is April 14, at 7:00 p.m.  Everyone is invited to attend. 

    Pilger reported the Little League Organizers would like an extra porta-potty at Community Park.  He said during little league season the park is heavily used.

    FINANCE – There was nothing to report.

    STREETS – The group discussed the various street projects being planned for the summer.  They also discussed the placement of the sign purchased by the Chamber.  Plyman will contact property owners to obtain permission to place the sign.   

    PUBLIC HEARINGS:

    Adoption of the Proposed “Code of Ordinances of the City of West Burlington, Iowa  1999” – Mayor Trousil opened the Public Hearing on the Proposed “Code of Ordinances of the City of West Burlington.  There were no comments received.  The Public Hearing was closed.

    Consider Amending the Zoning Code Concerning Residential use in a Business Districts – Mayor Trousil opened the Public Hearing on amending the Zoning Code Concerning Residential use in a Business District.  There were no comments received.  The Public Hearing was closed. 

    Consider Rezoning Certain Property Located on E. Agency Road from A-1 to B-2 – Mayor Trousil opened the Public Hearing on rezoning certain property located on E. Agency Road from A-1 to B-2.  There were no comments received.  The Public Hearing was closed. 

    Consider Rezoning Certain Property Located on West Agency Road and South Gear Avenue from I-1 to B-2 – Mayor Trousil opened the Public Hearing on rezoning certain property located on West Agency Road and South Gear Avenue from I-1 to B-2.
